Updated: Tourism protest claims conflicts of interest

Document also cited as a conflict animosity toward Bill Brown

Wednesday, December 10, 2008 1:32 PM PST
Posted 1:30 p.m., Wednesday, Dec. 10: Klamath County Commissioners John Elliott and Al Switzer had conflicts of interest in evaluating proposals for a new Klamath County tourism services contract, according to a protest document filed for tourism agency Travel Klamath. The protest, filed by a Medford law firm, said Elliott and Switzer’s advisory positions with Travel Klamath and the Klamath County Chamber of Commerce, respectively, created the conflicts. The two-page document also cited as a conflict potential animosity toward Commissioner Bill Brown, husband of Travel Klamath’s executive director.

Switzer said Tuesday he would try to address the protest this week.

Posted 4:05 p.m., Monday, Dec. 8: Just before 4 p.m. Travel Klamath officials filed a formal protest against the county for awarding a new tourism contract to the Klamath County Chamber of Commerce. Travel Klamath is the current contract holder.

Posted 2:30 p.m., Monday, Dec. 8: The current holder of Klamath County's tourism services contract has yet to file a protest against the county for awarding the new contract to the Klamath County Chamber of Commerce. Travel Klamath has until 4 p.m. today to file the protest. Bonnie Grant, contract specialist with the county's contracts department said a Medford attorney called asking questions about the situation but there was no assurance a protest would follow.

A Travel Klamath board member said Thursday there was a strong chance the organization would file a protest the county's decision. Check back at breaking news updates and Tuesday's Herald and News print edition for updates.

Travel Klamath did not lose because their plan was inferior - they lost because these two commissioners that refused to recuse themselves thought up a hair brained scheme to break the tie that involved having the two finalist groups talk about each other's presentations - say what????
If that isn't the most rinky dink scheme ever hatched - what is? Then they said Travel Klamath wasn't animated and enthused enough in their evaluation of the other team's presentation for the tie breaker. Since when does evaluation of another's presentation hinge on "animation and enthusiasm" by the second party? What? What? What? "

" I agree with C.O. It seems this fight is that TK didn't get the contract and thinks they should not have to fight for the renewal. That the renewal should be given to TK on the basis of having had it the past 3 years. That would be abuse of power on TK's half. Any new contract should be an opportunity for change or status quo and the commissioners get to make the final decision. "

Never a wrong doing, or shady deal on thier part.
Ask anyone who used the vet admin office about two years ago. Or maybe call the defunked klamath lake county training office that is closed and owes hundreds of thousands of dollars..and if you think that we tax payers wont have to pay it back..think again.
Ask anyone about the last tourism goat rodeo that both of them mucked up.

II thank God that there is a forum that allows us to express our displeasure. Don't tell these people to shut up, they have the right to express themselves. I know that your messiahs Al and John wants to shut everybody up, but it will never work.

I think we should look at term limits for commissioners now. When we get people in like these two, they buy their way into office year after year. You know they can't win an honest election. "

You Bring Shame wrote on Dec 14, 2008 3:19 PM:

" By continuing to make such outrageous accusations, merely to express your dissappointment that your team LOST the competition for the tourism contract, brings shame to our community. You present your accusations without any facts to support them. When you have been informed of the facts that disprove the very basis of your accusations, you all completely ignore them as if they were never discussed.

This indicates that you all are not just unreasonable, but also irrational.

Travel Klamath lost the contract because their proposal was inferior. This might be too mundane, or simple for you conspiracy fans, but it is the truth.

Our great community does not elect officials that engage in the activities you suggest in your false accusations, election after election.

You should appologize to John, Al, and our entire community for continually making false accusations. You should also appologize to the fine men and women associated with the Chamber of Commerce for your relentless remarks that diminish their outstanding effort that won them the contract. They won on merit, and not based on some weird conspiracy that you folks just won't let go of.

Congratulations to the Chamber, I am certain you will do us all proud!

And a very merry Christmas, and good will to you all. "

" I have read all the blogs-boy, they are something else. I have a question to all those that think this thing was dishonest: Please tell me what the two commissioners said about this when you personally talked to them about this situation. If you have not talked to them personally, then you really have no right saying all the terrible things you are saying. Maybe there is some knowledge that you are not aware of. So, did you talk to them personally, and then what did they say? If not, I put no validity in your commnents. A court of law always hears both sides before making judgments-all of you need to do the same thing!!!! "

Proof of accusations wrote on Dec 14, 2008 2:51 PM:

" Allan J-either come up with factual proofs of your slanderous accuasations or keep quiet. There are always two sides to everything, so if you have proof cough it up or quit throwing accusations around. "

" Am I the only one here that sees that this seems a little dishonest.

How can 3 people, each with some interest in each of these agencies fairly sit in judgement of a presentation?

At least we have one honest commissioner that excused himself from the process. The other two should have as well. I believe that this was all pre-planned as well.

We have to have checks and balances in the politial system. When we have two rogue commissioners that don't seek these checks and balances, everything they did in this process will be construed as dishonest. Adding one or 3 more people in this selection process would have made it an honest selection, and would not allow these two commissioners to use this event as political revenge. "

" There is a reason why Klamath County is the poorest in the state, as well as the laughing stock of the state. It's called these two commissioner.

There continued unethical and immoral actions have cost this county more than financially, it has cost this county the respect that it once had.

The continued actions of these two can no longer be tolerated, now is the time to recall. "

A citizen to James wrote on Dec 14, 2008 7:18 AM:

" Did you look at the actual scoring sheets? This is public information. I believe you can look at a score sheet. There are 7 categories with mulitple questions under each category. If you would reread the Herald and News paper where the categories were scored, then there is no way you could come to your outlandish conclusion. It seems you came to your own conclusions with predisposed disgust for the commissioners, so how can you say you would have been fair??? I just read LMAO's blog and agree with their conclusions. You have no facts to back up your accusations!! The process is working as it was explained to all parties. Let the process work. The Herald and News said the commissioners will be talking about this on Wednesday at 9 am at the public meeting. Maybe you should watch it. I sure am going to see it. Then, whatever the decision, we all need to let this come to rest and support the winner. Our county is far more important than someone's personal hateful attitude. "

LMAO wrote on Dec 13, 2008 6:29 PM:

" All of you conspiracy theorist need some Prozac. Your wild accusations are soooo funny.

The scoring was the culmination of the total sum of a multitude of scoring categories, not just "a score". John and Al are honest men and wouldn't even try to manipulate things. In this case, there were so many categories that had scores of 5 and 10 points, it wouldn't be possible.

These factors, combined with the fact that, with the exception of the Travel Klamath folks, the Chambers presentation was far superior to Travel Klamath, would lead every REASONABLE person to conclude that the Commissioners did a good job in this process.

Be careful how you slander people when you have sppon fed info that you are relying on.

There was no cheating....The Commissioners are honest people, and the Chamber EARNED the victory by submitting a far superior proposal. "

James wrote on Dec 13, 2008 5:01 PM:

" To: To Pete:

It is very simple. They got together beforehand each one told them what they were going to score to make it a tie. They decided to get together and make it look like a tie so it would LOOK like there was NO way possible for this to happen.

What they didn't realize was just the total opposite happened. ONLY preplanning this vote was the only way that this could happen.

They then pre planned that after the public THOUGHT this was a tie, that they will then award the contract to the Chamber.

What more proof do you need, it is only obvious that this is the only way that this could have happened. What PROOF do you have that they didn't do it this way. Obviously they can't fall back on their moral character, because that was lost a long time ago.

I do not have a dog in this fight, I don't care who gets it, I just want it done fairly, and I want these two to pay for their little "indiscretion". "

To Pete wrote on Dec 13, 2008 11:55 AM:

" Pete!!! The RFP spelled out the whole process!!!!!!!! ALL 4 groups accepted it. When the tie happened, BOTH groups accepted the process. Eveything was done according to the proces; all in public meetings. So, just because you lost, you want to change the whole process for YOUR way. And, for all those who assume that the two commissioners planned all this, I have one question: Were you with them when this happened??? Did you not read in the Herald and News, the numbers of the vote for each category?? There is no way the commissioners could have planned it out!! It really is not right to accuse someone of what is being said in these blogs unless you have proof. I would like to know what proof anyone has, or is it just assumption or presumptions? Those are dangerous. I have never seen such terrible losers as TK and company. If they would have won, would they still being making these accusations for intergrity sake, or accept the award and say nothing???? I will bet that I do not get an answer to that one. Also, it has been blogged: who is paying for all the legal fees? I bet I won't get an answer to that one, either. It is time to go on!! The decision is what it is; now get a life and support the winner of the contract! "

Who do you think will pay the Commissioner's lawyer fees if they don't give-in and re-do the selection? And it will be in the tens of thousands of dollars potentially. They were clearly biased, clearly a conflict of interest was present. So why, oh why, didn't they give the decision to an independant review board. They continue amatuer, arrogant? or just plain dumb decsion making. And we pay for it again! Maybe people's screaming will cause them to "re-bid" the whole deal without them making the decision. Come on people wrote on Dec 12, 2008 3:17 PM:

" Conscientious Observer:

As has already been pointed out, Dawnn Brown was the Great Basin Visitors' Association director before Bill Brown was elected as county commissioner.

For those whining about a conflict of interest ... I know you all realize that EVERY county department has a BOCC liaison. For example, Al Switzer is the liaison to the museums. Should he be required to recuse himself from any decisions involving the museums? With that logic, a "conflict of interest" argument could be made for any decision our commissioners make.

As for liaison appointments that aren’t directly related to county departments, Bill Brown is the liaison to the Regional Workforce Investment Board (succeeding John Elliott). Should he be required to recuse himself from any decisions involving KLETI or the local RWIB? You'd better believe he didn't see a conflict of interest there, or in sitting on the TOC/OWA board, which will ultimately decide what happens as a result of KLETI's issues, and potentially could cost this county a lot of money. You might also be interested to know that until just a few months ago (don’t know exactly when), Bill Brown was sitting in the same advisory position with the Chamber that Al Switzer is being accused of exploiting. Sure wish I knew why that change was made …

Furthermore, how is an independent panel going to weigh past performance or the ability to perform certain services without the luxury of assessing all the feedback - both good and bad – that our commissioners have gotten over the past five years? How is it fair that our county commissioners would have to live with a decision that DIRECTLY impacts the perception of how well they are doing their job, if they didn't have anything to do with the decision?

Some things to think about ... "

What troubles me is that both of these commissioners has an interest in one or the other of the two finalist.

What bothers me is the immoral and unethical ways these two commissioners do business.

What proof do you guys have that are whining about whos paying for the attorney fees. How do you know the people from TK are not paying for it themselves?

I feel when these two commissioners are found to have violated county policy, that these two should pay for the attorneys out of their own pockets.

Bottom line here is who ever gets the contract, it should be awarded fairly. The Chamber may have very well of been the best presentor, however these two have ruined the vetting process by their immoral, unethical and borderline illegal activities. "

Ignorance of contract law is no excuse. Or deliberate changing of the required number of judges, whether everyone "thought" it was legal or not does not make it legal. The rules are the rules - no matter what anyone "thinks" they should be.
That's why we have mistrials in the judicial system. If the letter of the law was not followed - it invalidates the outcome. "

Objections should have been made at that time, but not one of them did, not even Travel Klamath!!! It was done according to the lawful way, so you need to, along with the other Travel Klamath people, get over it and move on. I think the two commissioners that violated County rules should pay for it PERSONALLY - if we can't have the rules followed around here then what are rules for? "

I, too, think the Herald and News has an obligation to inform us, the public, as to what dollars are paying for the legal fees. We need tourism in Klamath County, and so every available dollar should be used for that; not for someone's legal fees because they could not "lose" respectfully, like the other groups did. "

This has given the "Charter bunch" the opportunity to do some more grandstanding with bad tempers headed by their out-going commissioner troop leader. Too bad. Two questions for you:
1) This RFP was issued on October 14, and on November 19th the identity of all four parties who had submitted proposals was made public. Why didn't you think to ask for an audit of all four organizations at that point?
2) This RFP was issued on October 14. A provision in the RFP allows for respondents to state any objections to the RFP and the selection process. Why didn't you or Dawn or Bill raise concerns then?

I can respect that you're probably their friend, and that they are both at the very least frustrated about being unemployed on January 1st, but your destructive practices for trying to help your friends are of no benefit to anyone but the three of you.

You, along with Mr. and Mrs. Brown have done much to damage this community's image and crush the spirit of many very good people who genuinely want this community to be better. These people have much more meaningful and socially redeeming things to do with their time than to wade through the piles of dooky you and the Browns keep laying down. Why don't you research this and then contact the county to ask them about it. Then, you can contact the newspaper and inform them. Here's a hint to start your research: Public contracting law in non-charter counties is governed by Oregon Revised Statutes, many of which are referred to in the RFP. Might want to start there. "

The Chamber won the contract fair-and-square, and a notice of intent to award it has been issued.

My questions are:
1) The RFP for this contract was issued on October 14. Why are you just now asking about an audit, and why didn't you mention that the sample contract in the RFP and general standards for public contracting require annual audits on public funds? Have you asked the Chamber or the County if this contract will require ongoing audits?
2) Why didn't TK cite their protests before the presentations (and according to an appeal process that is BUILT IN TO THE RFP)?

It's because Dawn and Bill think everything that happens in their life is some kind of personal attack, and their only effective way of communicating that is recruiting irrational people like you to continue making false accusations and citing incorrect information. They have lost enough credibility that they have no influence in making their case civilly or constructively, and their only way to cope with that is lashing out after a decision is made.

You, Bill and Dawn continue to make issues out of non-issues, and it is damaging this community and crushing the spirit of many good people who are genuinely trying to make a difference. "

" I think it's interesting John is on Travel Klamath's board and Al is oh the Chamber's board. Why didn't they get help from over the hill for this, it would certainly have defused the situation. They did the same thing when awarding the KCEDA contract, it was a forgone conclusion.
One would think the Chamber might be required to provide an audit before getting any tax money. Does anyone think its interesting there has not been an audit in many years? Why isn't there an annual audit? Travel Klamath has an annual audit, will the Chmber be required to do the same??
So interesting that this community had the opportunity to make changes in County government and now wants to gripe becase they get the same ol same ol..... "

Legal Fees wrote on Dec 9, 2008 4:52 PM:

" So they filed an appeal. What if there are lawyers involved? What if they decide to take the county to court? Are they going to use tourism funds to fight their appeal??? I would like to know. That is not where tourism dollars should go. How would that bring tourists to Klamath Falls? Let the whole world know that they cannot lose in a decent and mature way? I think someone should look into who is paying the legal fees for the protest??? "

Get over yourselves and move on! "

" it is a potential conflict of interest for a commissioner's wife to be the head of a county dept.,even when bill brown does not vote, because he still can influence others' actions. dawnn brown never did provide actual evidence to show that she increased tourism in the county, and did not collaborate well with others. " Dear Klamath County:

Please do not stand up for yourself, you will be labled a sore loser or a whiner, please just roll over and bow down to Al and John and continue to let them run this county into the ground.

When it is obvious that there are wrong doings, and the commissioners are pre-dispose on who is going to win a legal contract before even hearing any of the presentations, please do not question this unlawful activity.

Please succumb to the good ol boy venue that we have been so use to over the years, turn the other cheek and allow these two to get away with everything.

Do not question anything they do. If you do, your entire family will be labled as hooligans, they will then be drug through the mud without cause or justification to do so.

So in closing, please keep your mouths shut, and your eyes close, and everything will be ok.

Sincerely: A Concerned Citizen "

" Since the day she was given this contract Dawn has held the Klamath County tourism community hostage.

At the sole direction of Dawn, Travel Klamath decided "who, what, when and where" our tourism promotion investments were made.

As a tourism business owner I was told by Dawn and I quote " If you don't join my association I will not promote your business". In my book that is blackmail, It didn't matter that she had thousands of dollars of public money to promote tourism and the local providers. It was and is all about the money and the power over people it gave her.

Her own hand picked board of directors resigned and no one wants to talk about it or investigate the facts about the departures. I have been told this is because the parties involved know that she will 'punish' them if they speak the truth.

Bill Brown went on a mission to investigate the likes of KCEDA and KLETI but didn't lift a finger to look into the financial dealings of Travel Klamath. I know there were trip, meals and other expenditures that are questionable, but there was no one to investigate this contract.

As to the reputation of Travel Klamath, take a look at her work. She only promoted the people that went along with her. There are plenty of businesses that were 'banned' because we didn't like what she was doing.

Before this contract was awarded, Dawn stated publicly that she was going to fight anyone who got in her way and if she lost she wasn't going to share the resources that have been developed over the past 5 years. After all, it's her money, not the counties.

She only wants the money and the power, to hell with what is best for the promotion of tourism in our county.

She needs to go. "

" So standing up for your right is now considered a "Sore Loser".

Thats really nice. If you are a representative of the current commissioners office, I can now see why there is so much disention.

GET THE CHARTER BACK ON THE BALLOT. "

" To Past Deadline:

It's too bad you hooked on phonics didn't come in before you posted. This is what the actual article said.

Just before 4 p.m. Travel Klamath officials filed a formal protest against the county for awarding a new tourism contract to the Klamath County Chamber of Commerce.

"Just Before" means just that. "

AllanP wrote on Dec 9, 2008 9:51 AM:

" Good Job TK, at least someone is trying to keep these dishonest commissioners honest.

I know that this protest will fall on deaf ears as John and Al both decided long in advance who was going to get the contract this year, but at least your bringing out even further dishonesties in the commissioners office.

Good Job and Good Luck "

" WAAAAAAAAAA........WAAAAAAAA........WAAAAAAAAAAA

All this unreasonable reaction and dramatic accusations and threats brings me back to a time in my life when my team won the kickball games during recess in elementary school.

You don't like the outcome of the game so you protest the rules of the game....only after you lost. But until you lost, you didn't say a word.

All your silliness won't intimidate the 2 Commissioners. They have the strength, and the ethics to do the right thing in spite of your terrible blogs.

The Chamber did a supperior job in responding to the RFP. Travel Klamath did a terrible job. The presentations, and the tie breaker were both recorded and is available to anyone who wants the facts.

The Chamber presentation won them the contract. The community will not tolerate Travel Klamath and their supporters intimidating the Commissioners into a reversal of what was obviously the right decision. The Commissioners should ignore this dribble and finalize the award to the Chamber, and send these babies packing. "

Sore Losers wrote on Dec 9, 2008 8:32 AM:

" Sure proves that they are sore losers. Where are the other two groups? They accepted the decision and have had integrity and character about it. Too bad Travel Klamath can't lose with dignity and wish the Chamber well. "

Pawn wrote on Dec 9, 2008 6:30 AM:

" Why do you presume/assume the winner, the chamber, did not win 'on the merit of their proposal'? And where are you when it comes to an election? If John and Al are such poor leaders why has no one run against them and won? "

past deadline wrote on Dec 9, 2008 4:27 AM:

" If the deadline was 4:00 and the protest was turned in at 4:05 sorry thats too late, story over. Congrats to the Chamber for having the best proposal. "

Citizen wrote on Dec 8, 2008 10:54 PM:

" Any judge anywhere would have had to recuse himself/herself before sitting in judgement of his bench colleague's spouse in any sort of civil or other determination.
Why shouldn't Al and John have at least done the most basic thing for fairness and recused themselves before sitting in judgement of a five year contract involving Commissioner Bill Brown's wife's business?
They should have used the three to five member committee system required by Klamath County law. They really were arrogant on this account. "

Dishonest wrote on Dec 8, 2008 9:07 PM:

" Thank God, but we all know that with these two we that there will not be a fair decision.

A independent committee NOT picked by the commissioners needs to make the decision.

It is so obvious that they pre-planned how they were going to vote originally to cause a "tie" it makes me sick. How can someone this dishonest be in charge of our county? "

Lets see wrote on Dec 8, 2008 6:20 PM:

" I agree with you look out. These 2 Commissioners are a disgrace. I dont care who wins as long as its done honestly and fairly. It was rigged and anyone who lives in this community and has watched these 2 in action, knows it.
Why cant people do things for the betterment of this community? Its saddens me to see this kind of thing going on. "

look out wrote on Dec 8, 2008 4:49 PM:

" This will be very interesting to watch this play out. This has all the potential to drag down two commissioners.
This is the 2nd time that both John and Al have been involved in with the process and the 2nd time it has turned into a complete fiasco.
I could care less and have no intrest in who wins, as long the winner won on the merit of thier proposal as apposed to being victimized by people with an axe to grind.
I have said it before and I will say it again, other communties look at the "leaders" of Klamath county and Laugh out loud.
Yup, I know, there will be people who say that complaining does not help. to you I offer this, I wonder how life is were you live, were you can try to put some positive spin of every stupid thing people do..sugar coat it, get people to swallow it and nothing changes.
Each of us has the right to freedom of speech...not just freedom of positive speech..ANY speech.
I speak this...PLEASE GET RID OF THOSE TWO...they will be the total undoing of this county if we dont. "
