Fee reduced for appeals of planned resorts

 Klamath County commissioners approved a temporary reduction in a fee for those wishing to appeal planning commission decisions on proposed projects. The reduced fee is now $1,850 plus 20 percent of a project’s original application fee. It was formerly the full cost of an appealed project’s original application fee.

The reduction was approved as the county prepares to hold hearings on the proposed Crescent Creek Resort in northern Klamath County. Under the original fee, an appeal of the resort’s plan would have cost $50,000. Now it would cost $11,850.

These guys roll over for big business, but stick it to the homeowner who wants to improve his property.

They dump $40k plus of revenue back into the pockets of land-raping developers. Meantime, county budget gets raided for a corporate welfare program for an airline.

Commissioners, like the rest of our government are in the pocket of big business. Time for new management! "

" See, this is the problem, the appeal costs are mind boggling. That is why the county and the city have a free ride to pretty much do as they please, unless land use development agency or odot gets involved, there is nothing to stop them. Outside of that the normal citizenry that the County and City represent doesn't have a chance. The County and City are not bound by any rules as long as you are not going to take the matter to an appeals court, and they are betting you won't because it will cost you to much to fight it. And if you are willing to fight it, then that is just the first step, because they will just adjust their decision a little and then you will have to go back to appeals court again and again. Like I have always said when going into a County or City meeting regarding your rights or property rights such as rezoning, always have a lawyer. The last thing the County or the City wants is to be called on to the carpet for not following the law, they could receive a heavy suspension. So be smart and know our Cities and Counties comprehensive plan and codes and state laws, and always have a lawyer right from the get go. Our commissioners and councilmen are not going to stand up for your rights. They are not going to follow the compprehensive plans or codes, even if you point them out to them. The only thing they will respect is your lawyer and the violations he can bring forth. "
